Zsaso Terms of Service

Draft for discussion. Not yet in effect, and not reviewed by a lawyer. Text in [brackets] needs a decision. Have counsel review before public launch.

These terms are an agreement between you and [Operator legal name] ("Zsaso", "we"), which operates the Zsaso service at zsaso.com and in the Zsaso apps. By creating an account you agree to these terms, the Privacy Policy, and the Code of Conduct.

1. What Zsaso is

Zsaso is a community where creators — writers, photographers, artists, and others — publish work and talk with the people who follow them. Zsaso is funded by its members, not by advertising. We do not show ads, sell your attention, or sell your data.

2. Who can use Zsaso

You must be at least 13 years old. If you are under the age of majority where you live, you confirm that a parent or guardian agrees to these terms on your behalf. [Consider 16+ or 18+ for members who pay.]

You may create one account for yourself. You may not create accounts for others, use someone else's account, or create accounts to evade enforcement.

3. Accounts

• Reading is free. Anyone can read public posts and profiles without an account.
• Membership is a paid subscription that lets you interact: reply, like, follow, and send direct messages. See §6.
• Creator accounts may publish posts. Creators pay [a small fee]. See §6.
• You are responsible for what happens under your account. Keep your sign-in email secure.
• We may suspend or close accounts that violate these terms or the Code of Conduct, following the process described there.

4. Your content

You own what you make. Publishing on Zsaso does not transfer ownership of your work to us.

License to us. So that we can run the service, you grant Zsaso a non-exclusive, worldwide, royalty-free license to store, reproduce, resize, display, and distribute your content on Zsaso and through Zsaso's features, including delivering your public posts to people who follow you from other services (see §8). This license ends when you delete the content or your account, except for copies that have already been delivered to other servers and for records we must keep by law.

What we will never do with your content. We will not sell, license, or otherwise provide your content to third parties for training artificial-intelligence or machine-learning models, and we will not use it to train such models ourselves. We send machine-readable opt-out signals on your behalf by default; you can change this in your settings.

Your responsibilities. You must have the rights to what you post. Don't post content that infringes someone else's copyright, trademark, privacy, or other rights, or that violates the Code of Conduct.

5. Direct creator support

[Later phase.] Members may send money directly to creators. Zsaso passes payments through Stripe and keeps a small platform fee, disclosed at the time of payment; the remainder goes to the creator. Support is a gift: it does not buy content, access, or any obligation from the creator. Refunds are at Zsaso's discretion and generally only for errors or fraud.

6. Fees and billing

• Memberships and creator fees are billed by subscription through Stripe on our website, or through Apple or Google in-app purchase where offered. Prices are shown before you subscribe and may differ by channel.
• Subscriptions renew automatically until cancelled. Cancel any time from your billing settings (or from Apple or Google if you subscribed there); access continues until the end of the paid period.
• Fees are non-refundable except where the law requires otherwise or as stated at purchase.
• Taxes are added where applicable.
• We may change prices with at least [30 days'] notice; changes apply from your next renewal.

7. Acceptable use

Follow the Code of Conduct. In addition, you may not:

• access Zsaso by automated means (scraping, crawling, bulk downloading) except through interfaces we publish for that purpose, including search engines that honor our robots.txt;
• use any Zsaso content to train, fine-tune, or evaluate artificial-intelligence or machine-learning models;
• interfere with the service, probe its security, or circumvent access controls;
• sell, transfer, or share your account.

8. Federation

Zsaso can connect to other services that speak the ActivityPub protocol (such as Mastodon). If you enable this, people on those services can follow you and copies of your public posts are delivered to their servers, which are run by other people under their own rules. We cannot delete content from other servers, though we send deletion requests when you delete a post. You can control how much of each post is delivered in your settings.

9. Copyright complaints

If you believe content on Zsaso infringes your copyright, send a notice to our designated agent:

Include: the work you own, the URL of the infringing content, your contact details, a statement of good-faith belief, a statement under penalty of perjury that you are authorized, and your signature. We remove infringing content and terminate repeat infringers. Users may file a counter-notice; we follow the procedures in 17 U.S.C. §512.

10. Privacy

The Privacy Policy explains what we collect and why. In short: what you need to run an account, nothing sold to anyone.

11. Ending your account

You can delete your account at any time from settings on the web or in the app. Your public content becomes unavailable immediately; we permanently delete it, and your account data, after a [30-day] grace period, except for records we must keep by law (for example, moderation and payment records). You can export your posts and images before deleting.

We may suspend or close your account for violating these terms or the Code of Conduct, or if required by law. Where possible we'll tell you why and how to appeal.

12. Disclaimers and limits on liability

Zsaso is provided "as is." We work hard to keep it running and safe, but we don't guarantee it will be uninterrupted or error-free, and we are not responsible for content posted by others. To the fullest extent the law allows, Zsaso's liability to you for any claim is limited to the amount you paid us in the [12 months] before the claim. Some jurisdictions don't allow certain limits; in that case these apply to the extent permitted.

13. Changes to these terms

We'll notify you of material changes at least [14 days] before they take effect, by email or a notice on the service, and ask you to accept the new version. The version and effective date are at the top of this document.

14. Governing law

These terms are governed by the laws of [State], United States, and disputes are resolved in the courts located in [County, State], unless the law where you live gives you other rights.
